Jotgo Terms & Conditions

1. INTRODUCTION

Welcome to JotGo, a software-as-a-service ("SaaS") platform operated by Digital Avenues Pte. Ltd., a company registered in Singapore ("JotGo," "Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website, services, and integrations with third-party applications (collectively, the "Services").

By accessing or using JotGo, you agree to be bound by these Terms. If you do not agree, you may not use our Services.

2. DEFINITIONS

  • "User" refers to any individual or entity that registers, accesses, or uses the Services.
  • "Account" refers to a registered account required to access the Services.
  • "Subscription" refers to the paid access to premium features of JotGo.
  • "Content" refers to any data, feedback, reports, or material submitted, shared, or stored within the Services by Users.
  • "Third-Party Services" refers to integrations with third-party software, including but not limited to Jira, Monday.com, and Stripe.

3. ACCOUNT REGISTRATION AND USAGE

  • To access certain features of JotGo, you must create an Account and provide accurate and complete information.
  • You are responsible for maintaining the confidentiality of your credentials and all activity under your Account.
  • You agree not to share, transfer, or sublicense your access to the Services without prior written consent from JotGo.
  • We reserve the right to suspend or terminate Accounts that violate these Terms or misuse our Services.

4. SERVICES AND SUBSCRIPTIONS

  • JotGo operates on a subscription-based model with various plans, including potential freemium offerings.
  • Subscription fees, renewal policies, and applicable charges are disclosed at the point of purchase.
  • We reserve the right to update pricing and subscription plans with prior notice.
  • Users acknowledge that the availability and functionality of integrations with Third-Party Services depend on the third parties providing them.

5. USER CONTENT AND DATA COLLECTION

  • Users may submit Content, such as bug reports, comments, and other feedback, via the Services.
  • By submitting Content, you grant JotGo a non-exclusive, worldwide, royalty-free license to use, reproduce, and process the Content solely for service improvement and functionality.
  • JotGo collects and stores personal data, including names and email addresses, in compliance with applicable data protection laws.

6. INTELLECTUAL PROPERTY RIGHTS

  • All content, technology, trademarks, and features of JotGo are the exclusive property of Digital Avenues Pte. Ltd.
  • Users may not copy, modify, distribute, sell, reverse-engineer, or exploit any part of the Services without our explicit written consent.
  • Any unauthorized use may result in termination of access and legal consequences.

7. PAYMENT, REFUNDS, AND CANCELLATION

  • All payments for subscriptions are non-refundable unless explicitly stated otherwise.
  • We may review refund requests on a case-by-case basis at our sole discretion but are under no obligation to grant refunds.
  • Users may cancel their subscription at any time; however, they will retain access to paid features until the end of their current billing cycle.

8. DISCLAIMERS AND LIMITATION OF LIABILITY

  • No Warranty: JotGo is provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied.
  • We do not warrant that:
    • The Services will be uninterrupted, error-free, or fully secure.
    • Bugs reported via JotGo will be resolved or addressed by third-party integrations.
  • Liability Limitation: To the maximum extent permitted by law, JotGo shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of:
    • Service downtime, data loss, or delays.
    • Third-party integration failures.
    • Unauthorized access or misuse of your Account.

9. DISPUTE RESOLUTION AND GOVERNING LAW

  • Any disputes related to these Terms shall be resolved exclusively through binding arbitration in Singapore.
  • Users waive the right to participate in class-action lawsuits or seek relief in court.
  • These Terms shall be governed by and interpreted in accordance with the laws of Singapore.

10. TERMINATION AND ACCOUNT SUSPENSION

  • JotGo reserves the right to suspend or terminate Accounts that:
    • Violate these Terms or applicable laws.
    • Engage in fraudulent, abusive, or harmful activities.
    • Attempt to disrupt or misuse the Services.
  • Upon termination, Users lose access to all stored data and must discontinue use of the Services.

11. CHANGES TO THESE TERMS

  • We reserve the right to update these Terms at any time, with material changes communicated via email or in-app notifications.
  • Continued use of the Services after changes constitute acceptance of the updated Terms.
